Grounds for Divorce in Washington State

When it comes to divorce or dissolution of marriage, the only grounds necessary is the fact that there is an “irretrievable breakdown of the marriage”. This means that one spouse in the marriage believes that marriage cannot be saved. Washington state does not require proof against that the other spouse is “at fault” for the breakdown of the marriage.

How to File for Divorce in Washington State

Note that there is a residency requirement before filing your petition (your formal request for divorce). You or your spouse must currently live in Washington. If your situation involves military divorce, you or the spouse may be stationed in Washington.

If you (the “petitioner”) are seeking a divorce, you must file a Petition for Dissolution of Marriage. This is served to the other spouse (the “respondent”). The respondent has 60 days to reply (in writing) to the petition. If the respondent agrees to the petition, the court will enter what is called a “decree of dissolution”. If the respondent does not agree, the court will review all factors in the case, including the circumstances leading up to the filing of the petition and the chances the couple can reconcile.

Everything depends on the court’s ruling. They may rule in favor, dismiss the petition, or refer the couple to family court and counseling.

Be aware that there is a 90-day waiting period before the court can issue a divorce decree. This means the petitioner must file and serve the Petition for Dissolution of Marriage to the other spouse for 3 months before the court can issue a divorce decree. If the other spouse does not agree, the waiting period can last even longer.
